ARE THEY REALLY HIDING THE EVIDENCE? OR SIMPLY PROTECTING THE RIGHT TO PRIVACY?

Not every objection to the public disclosure of documents means someone is hiding the truth.

During the impeachment trial of Vice President Sara Duterte, the objection raised by Atty. Kristine Ferrer, a member of the defense team, against the public display of the tax returns of VP Sara Duterte and Atty. Manases Carpio became a subject of controversy.

The reason? Protecting sensitive personal information in accordance with the Data Privacy Act.

However, some immediately interpreted the objection as an attempt by the defense to conceal evidence from the public.

But wait! Let’s get the facts straight.

Atty. Ferrer herself clearly stated:

“We are not preventing the prosecution from presenting as evidence these tax returns.”

The point is clear: The defense is not preventing the submission of evidence. What they are opposing is the public display of the actual tax documents.

Those are two completely different matters!

Under the ruling of Senate President Francis Escudero, the presentation of BIR summary tables was allowed, but the public disclosure of the original tax returns was restricted.

So, is it really fair to accuse the defense of hiding evidence when the impeachment court can still examine those documents?

NOW, LET’S TALK ABOUT THE NUMBERS

According to the figures presented during the hearing:

• ₱85.34 million – The reported combined after-tax income of VP Sara Duterte and Atty. Manases Carpio from 2007 to 2025.
• ₱91.41 million – The reported increase in VP Sara Duterte’s net worth based on her Statement of Assets, Liabilities, and Net Worth (SALN).
• Approximately ₱6.07 million – The difference between these two figures.

Are there questions that need to be answered? Absolutely! The public deserves a clear explanation.

However, it is important to understand that after-tax income and changes in net worth cannot automatically be compared as if they were the same financial measure.

Assets, liabilities, other legitimate sources of wealth, and supporting financial records must be carefully examined before drawing conclusions.

According to the arguments presented, the BIR witness also had limitations in explaining matters concerning the SALN.

Meanwhile, the defense has not yet completed its opportunity to present its own evidence.

Why rush to judgment when both sides have not yet fully presented their cases?

THE TRUTH SHOULD NEVER COME AT THE EXPENSE OF DUE PROCESS

Some people say, “The truth is not confidential.”

That sounds powerful, and yes, the truth must come out.

But transparency does not necessarily mean that every sensitive personal document must be publicly displayed.

Evidence can be thoroughly examined while still respecting the law, individual privacy, and the rights of everyone involved.

An impeachment trial is a constitutional process intended to establish facts and determine accountability.

It is not a competition over who can deliver the first guilty verdict on social media.

If there are discrepancies, establish them through evidence.

If there are allegations, investigate them fairly.

If the defense has explanations, allow them to be heard.

Because genuine justice cannot be achieved through accusations alone.

Justice requires credible evidence, fairness, transparency, and respect for due process.

The public deserves the truth, but that truth must be established through a fair and lawful process—not through speculation, selective presentation, or premature judgment.

Ang impeachment trial ay proseso ng paghahanap ng katotohanan at pananagutan, hindi paligsahan kung sino ang unang makakabuo ng hatol sa social media.

Kung may pagkukulang, patunayan sa ebidensya. Kung may alegasyon, siyasatin nang patas. Kung may depensa, pakinggan din.
